RIL to file application over gas supply to NTPC

Mumbai: Reliance Industries Limited (RIL) is scheduled to file its application in Bombay High Court tomorrow (Jan 16,2006) on its dispute with National Thermal Power Corporation (NTPC) over signing of Gas Supply and Purchase Agreement.

Country's biggest power producer NTPC and RIL are at loggerheads for the last two months over the gas supply contract as NTPC has filed a petition in the court, seeking ad interim relief against RIL for not signing the GSPA and prayed for execution of the contract by it.

Despite numerous attempts for solving the dispute between the two power giants, no breakthrough was achieved and finally on December 23 last year, Justice S F Vajifdar had adjourned the case till tomorrow as RIL had sought time to file its application.

The court had also refused to grant ad interim relief to NTPC, which seeked an order restraining RIL from entering any gas supply with any other party.

RIL has already signed expression of interest for supplying 132 trillion British thermal units of gas to NTPC's 2,600 MW plants in Kawas and Gandhar in Gujarat at US dollars 2.37 per MBTU gas for 17 years from 2007.

However, during the hearing it had argued the project has become unbankable in view of uncapped liability clause in the GSPA.

NTPC is expected to file a rejoinder on January 27 and next hearing is scheduled at January 30.
